By accessing or using Takeoff Magic ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Takeoff Magic is a cloud-based software application that allows users to manage, annotate, and collaborate on blueprints and construction documents through web and mobile interfaces.

3. Subscription and Payment Terms

3.1 Subscription Plans

Service is provided on a monthly subscription basis.

3.2 Payment

Subscription fees are charged monthly in advance. Payment is due on the subscription start date and monthly thereafter.

3.3 Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date.

3.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

3.5 Refunds

No refunds are provided for unused portions of subscription periods.

4. User Accounts and Data

4.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials.

4.2 User Data

You retain ownership of all blueprints, documents, and data you upload to the Service.

4.3 Data Backup

While we maintain regular backups, you are responsible for maintaining your own backup copies of important data.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload malicious code or content
• Attempt to gain unauthorized access to the Service
• Share account credentials with unauthorized users
• Reverse engineer or copy the Service

6. Intellectual Property

6.1 Service IP

The Service and its technology remain the exclusive property of Takeoff Magic, LLC.

6.2 User Content

You grant us a limited license to process and store your uploaded content solely to provide the Service.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects service availability.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAKEOFF MAGIC, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless Takeoff Magic, LLC from any claims arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate your account for violation of these Terms or non-payment of fees. Upon termination, your access to the Service will cease.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification.

13. Governing Law

These Terms are governed by the laws of the State of Kansas, USA.
